48-year-old Kuna man to spend up to 40 years in prison on child porn and injury to child charges

A 48-year-old Kuna man who has been in the Ada County Jail since December 2020 for having illegal sexual contact with a pre-teenage girl and possessing child pornography will spend at least the next 20 years in prison — and possibly longer.

Garrett C. Mallery found out his fate Tuesday when he was sentenced for six counts of possession of sexually exploitative material and one count of felony injury to child.

4th District Judges Patrick Miller and Peter Barton sentenced Mallery to a total of 40 years in prison for his crimes — but Mallery is eligible to ask for parole after serving 20.

Detectives began investigating the case in December 2020 after a relative of the girl contacted Kuna Police and told them they just found out Mallery had illegal sexual contact with the girl on several occasions since April at a Kuna-area home.

Mallery’s home functioned as an in-home day care in the Linder/ Deer Flat roads neighborhood.

Detectives gathered enough evidence in two days to find and arrest Mallery on a lewd conduct charge. As part of that investigation, detectives found multiple illegal images on Mallery’s cell phone.

Mallery pleaded guilty to the seven felony charges in the middle of a jury trial earlier this spring as part of a plea agreement.
