UPDATE: 1 year-old Boise boy found safe in Utah; Amber Alert cancelled

Update: Missing 1-year-old Boise boy –  Legend Garza-Cota – has been found safe in Draper, Utah. His mother, 39-year-old Marisol Garza, is in custody.

We would like to thank the US Marshals and Draper Police for all their work and effort to find Marisol Garza. She has been arrested on an Idaho warrant and the boy is safely in the custody of Utah’s Child Protective Services.

The arrest of Marisol Garza cancels the Amber Alert that was issued earlier today in Ada County

Ada County Sheriff’s deputies  issued the Amber Alert for 1 ½ year-old Legend Garza-Cota on Thursday just after Marisol Garza announced on Facebook she was leaving Idaho with Legend, who should be in the custody of the State of Idaho after he was declared to be in imminent danger earlier this month.

Boise Police began investigating the case on December 14, when Marisol Garza gave birth to a baby girl, who tested positive for methamphetamine at a local hospital. Garza also tested positive for meth at the same time.

Garza gave birth on the way to the hospital, and when she arrived, she had Legend with her. Garza left the baby at the hospital the next day. She took Legend with her. The newborn baby was placed in imminent danger and placed into the custody of the Idaho Department of Health and Welfare.

Investigators began looking for Marisol Garza, who said she was homeless, and Legend to make sure he was safe.

They were not able to find either. Investigators declared Legend to be in imminent danger, and a court order issued earlier this week placed him into state custody.

Garza went on Facebook Tuesday and said she was leaving the state because was not going to let the state take Legend away.
