RE: | State v. Garrett Mallery – Sentencing |
BOISE – On Tuesday, 48-year-old Garrett Mallery was sentenced to serve up to 40 years in prison for possessing sexually exploitative materials of children, and injury to a child.
Mr. Mallery was arrested in December 2020 after an investigation found he had inappropriately touched a child who attended daycare at the residence he lived in. Initially the defendant was only charged with one count of sexual abuse of a minor. However, the investigation led to more charges including lewd conduct with a minor under 16, and another case charging the defendant with 12
counts of possessing sexually exploitative material of a child.
In March 2022, Mr. Mallery pled guilty to felony injury to a child, and six counts of possession of sexual exploitation of a child.
Mr. Mallery was sentenced for both cases Tuesday. Honorable Ada County District Judge Peter Barton ordered the defendant to serve 40 years in prison, with 20 years fixed before being eligible for parole in the sexual exploitation of a child case. Honorable Ada County District Judge Patrick Miller sentenced Mr. Mallery to 10 years in prison for the injury to child case, which will be served concurrently, meaning at the same time, as the other sentence.
