Submitting a Public Record Request to the Ada County Prosecutor’s Office

The Idaho Public Records Act ensures government transparency to the citizens of Idaho by guaranteeing access to records created and maintained by local agencies. To submit a public record request to the Ada County Prosecuting Attorney’s Office, complete the Online Public Records Request Form. Please be as specific as possible regarding the record(s) you seek—it will help us locate the records more efficiently.

Please note that not all information is releasable under the Idaho Public Records Act. Because of this, our office cannot provide information such as, but not limited to:

  • Certain investigation records from open and/or closed cases;
  • Attorney work product;
  • Victim and witness personal information;
  • Records regarding sealed cases.

If you are looking for police reports, we recommend contacting the law enforcement agency who created the report, which may include the Ada County Sheriff’s Office.

If you are looking for court records, please submit a request through the Ada County Clerk’s Office.

Please note that Idaho law prohibits the use of the Idaho Public Records Act as a discovery tool.

Requests received after 5:00 p.m. or received on a holiday or weekend will be considered as submitted on the next business day.

Your privacy is very important to us. However, please be mindful that any information contained in your public records request submission may become a public record, including your name, other names, addresses, phone numbers, and email addresses.

How do I request public records?

Public records requests must be submitted in writing. You may complete and submit the Online Public Records Request Form or you can complete the written Public Request Form and mail it to the Ada County Prosecutor’s Office at 200 West Front Street, Boise, Idaho 83702 or email it to [email protected].

Will I be charged for copies of the information I receive?

Most public records are distributed free of charge. However, if your request takes Ada County employees longer than two hours to locate and process, we will provide you a fee estimate and require prepayment before proceeding. If we overestimate the fee, we will return that portion of the fee to you. For more information regarding the cost of obtaining public records, please see Idaho Code § 74-102.

How long will it take until I receive the records?

It usually takes 3-10 business days from the day you submit the request to the time you receive records. However, response times vary depending on the complexity of your request. We will do our best to communicate with you about the status of your request.

How will I know if my request has been granted or denied?

If your public information is approved, in whole or in part, the requested documents will be released to you via the preferred delivery method marked on your request form. If your request is denied, you will receive a letter explaining the reason for the denial.

Additionally, if you do not hear back within 10 business days of submitting your request, Idaho law considers the request denied.

How do I appeal a denial?

To appeal a denial, you must file a petition with the district court within 180 days from the date of mailing of the notice of denial.

How do I request a background check on someone?

Ada County does not provide background checks for the public. However, you can request a statewide background check through the Bureau of Criminal Identification
