12-31-13 State v Greggory Lee Macho – Sentencing

Today, Greggory Lee Macho, 31 years of age, was sentenced in Fourth District Court by Judge Patrick Owen to a total term of fifteen years fixed and fifteen years indeterminate for a period of 30 years for the felony crimes of aggravated assault, aggravated battery with an enhancement for using a deadly weapon, and concealment & destruction of evidence.  The Defendant was arrested June 5, 2013 for crimes he committed in the Boise Town Square Mall on May 14, 2013 after an exhaustive manhunt by law enforcement. 

  The Defendant parked his truck behind a car where he assaulted 22 year old Kayla Flink, a female who was unknown to him.  Angela Smoot, visiting from out of town with her two sons ages 5 and 7, ran to the vehicle to aid Ms. Flink after hearing crying and screaming coming from the vehicle.

The Defendant then returned to his vehicle where he accelerated and swerved running over Ms. Smoot who suffered serious injuries and was hospitalized for three weeks and continues to be in therapy. 

After news agencies ran a description from mall surveillance of the truck and an artist sketch of the attacker, the Defendant altered the appearance of his truck with assistance from his wife and brother.  At the time of the attack, the Defendant was on felony probation from November 2012 for a Grand Theft conviction after having served a period of Retained Jurisdiction.
